End User License Agreement (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you (“User” or “you”) and MONO APPS OU (“Company,” “we,” “us,” or “our”) for the EduAI mobile application and related services (collectively, the “Application”). By downloading, installing, accessing, or using the Application, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not use the Application.

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Application on your personal devices
• Use the Application for your personal, non-commercial educational purposes
• Access and use the features and services provided through the Application

This license does not grant you any rights to use our proprietary algorithms, source code, or other intellectual property for any purpose other than using the Application as intended.

You may not:

• Copy, modify, adapt, alter, translate, or create derivative works of the Application
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Application
• Remove, alter, or obscure any proprietary notices, labels, or marks on the Application
• Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Application
• Use the Application for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the Application or its related systems
• Use automated systems (bots, scrapers) to access the Application without permission
• Interfere with or disrupt the integrity or performance of the Application

Some features of the Application may require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

The Application is intended for users who are at least 13 years of age. If you are under the age of 18, you represent that you have obtained parental or guardian consent to use the Application and agree to this EULA. If you are a parent or guardian permitting a minor to use the Application, you agree to be bound by this EULA and are responsible for the minor’s use of the Application.

The Application, including all content, features, functionality, design, text, graphics, logos, icons, images, audio clips, video clips, and software, is owned by MONO APPS OU or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You acknowledge that the Application contains proprietary and confidential information. All rights not expressly granted to you in this EULA are reserved by MONO APPS OU.

The Application may allow you to upload, submit, or transmit content, including but not limited to text, images, and other materials (“User Content”). You retain ownership of your User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and providing the Application.

You represent and warrant that you own or have the necessary rights to grant the license above and that your User Content does not violate any third-party rights or applicable laws.

The Application may offer in-app purchases and subscription services. By making a purchase, you agree to:

• Pay all charges associated with your purchase
• Comply with the terms of any third-party payment processor (e.g., Apple App Store, Google Play Store)
• Understand that purchases are final and non-refundable unless required by law or as specified in our refund policy

Subscription fees will be charged to your payment method on a recurring basis. You may cancel your subscription at any time through your device’s app store settings.

Your use of the Application is also governed by our Privacy Policy, which is incorporated into this EULA by reference. By using the Application, you consent to the collection and use of your information as described in our Privacy Policy.

We collect and process certain information to provide, maintain, and improve the Application, including but not limited to usage data, device information, and content you submit.

We may update, modify, or discontinue the Application at any time, with or without notice. We may also update this EULA from time to time. Continued use of the Application after such changes constitutes your acceptance of the updated EULA.

This EULA is effective until terminated. We may terminate or suspend your access to the Application immediately, without prior notice, if you breach this EULA. Upon termination:

• Your right to use the Application will immediately cease
• You must delete all copies of the Application in your possession
• All provisions of this EULA that by their nature should survive termination will survive

THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that the Application will be uninterrupted, error-free, or free from viruses or other harmful components. We are not responsible for any content, accuracy, or opinions expressed in User Content.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MONO APPS OU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE APPLICATION.

You agree to indemnify, defend, and hold harmless MONO APPS OU and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney’s fees) arising from your use of the Application or violation of this EULA.

This EULA is governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes arising out of or relating to this EULA shall be resolved in the courts of Estonia.

If any provision of this EULA is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this EULA shall otherwise remain in full force and effect.

This EULA, together with our Privacy Policy and Terms of Use, constitutes the entire agreement between you and MONO APPS OU regarding the Application and supersedes all prior agreements and understandings.
